All terms and conditions are in relation to the supply of products and services from ‘VITATIA Design Group’ this includes purchasing via VITATIA.com, auction websites and direct via email, telephone or in person. Please read all terms and conditions carefully before placing an order. By ordering any of our Products or services, you agree to be bound by these terms and conditions.

Payment
All design work must be paid for upfront unless otherwise agreed. We can only provide a refund before work has commenced. If you are unsatisfied with the design or the designer, you must contact Jenny immediately to discuss your concerns so that she is able to create a satisfactory outcome.
Paypal payments must be made to JLoudenton@aol.com and cheques must be made payable to J L Denton and sent to VITATIA, 11 Wright Avenue, Rudheath, Northwich, Cheshire CW9 7LG.
Work cannot commence until payment has cleared.

Design Process
All work is carried about by professional designers. Each team member is expected to have registered as a sole trader, should they be unable to provide proof of self employment their contract will terminate. If you are unsatisfied with the design or the designer, you must contact Jenny immediately to discuss your concerns so that she is able to create a satisfactory outcome. Initial artwork is sent within 4 working days. If you require your artwork sooner there is a 100% premium. If you require artwork within 1 working day there will be a further 100% charge, you will be expected to respond with any changes urgently, it isn't the responsibility of VITATIA if the artwork isn't completed on time due to extensive amendments and/or irregular feedback from the client.

We also offer a text sms service where we can alert you that you have received an update through email. This service is charged at 50p per alert.

Copyright
We pride ourselves on offering a quality service and therefore offer design and artwork services that begin from scratch. We are strongly against plagarism and expect our designers to adhere to copyright law. In the event that a designer knowingly breaches copyright law their contract will terminate once outstanding work has been completed. If you believe your artwork breaches copyright please contact Jenny and she will investigate the matter and is able to organise a redesign if plagarism has occured.
Any photographed images we provide will either be taken by our resident photographer, or we will purchase the licenses for relevant stock photographs. If you provide any logos or artwork to go on your design it will be assumed that you have the relevant license or permission to use them.

Please note: If you are taking any images off the internet to use for yourself make sure that they are licensed for commercial use, just because an image comes up on an image search doesn't mean it is copyright free.

Printing
Artwork is created in CMYK with all fonts outlined, all images embedded, 5mm bleed, crop marks and as a PDF or high resolution JPEG. If you already have chosen a printer please email us a link to their website so we can create the artwork to their specifications. If you are printing with Vistaprint please let us know as soon as possible as their sizes are American which can work out very different to the standard UK sizes we work to.

VITATIA's printing is normally within a 5-7 working day turnaround. We can get the prints over to you within 3 working days for a 25% premium. If you wish to use our printing service please let us know and we will send out a proof of the print. You must approve your artwork before 18:00 gmt for us to include it in the next printing run. We post all printed designs straight to the client, although we aim to have 100% customer satisfaction should any errors occur please contact us immediately. If the error has occurred through VITATIA after approval we will provide a reprint free of charge. VITATIA cannot be held accountable for costs incurred should you not receive your artwork in time for your marketing plans (with or without a reprint), and suggest you leave adequate time to allow for any delays or errors in the design/print process.

Upon approval you will be sent either a pdf or high resolution Jpeg to print. By accepting the artwork you are agreeing that the design is correct and any errors found during or after print are not the responsibility of the designer or VITATIA. Any changes made after approval may incur a charge.

 


Privacy Policy

The personal data (for instance name, address, payment information) you have provided us with will be used for the fulfilment and processing of the contract. Our goods are delivered by courier and this company will be given access to your data as far as this is necessary for the delivery of the goods.

The Contract Between Us
Your order constitutes an offer to us to buy a product or service. All orders are subject to acceptance by us and we will confirm acceptance either by sending you an email confirming your order or accepting payment. A legally binding contract between us will be formed only when we send you this order confirmation email or receive payment.

You will not have any right to cancel a contract for the supply of any of the Products already produced or being produced because the cancellation rights do not apply to the sale of custom-made articles or goods made to a consumer’s specification.

Delivery of Goods
All the specified delivery schedules will not be fixed and should be used as guidelines only. Although every effort will be made to adhere to these schedules, a reasonable delivery time extension shall be put in place and we state that this should be a maximum of 14 working days from when order confirmed or payment received whichever is the latest.

Returns & Complaints
Returns of any kind must be agreed to by us.

Deviations in colour reproductions from the original, regardless of production technique, cannot be rejected. The same applies, for technical reasons, for the comparison of templates and the like, e.g. proofs and print-outs even though they have been made by us, and the finished product.

Faulty parts of the delivered goods do not warrant rejection of the complete delivery.

Complaints made solely because you have failed to heed the information on requirements for the print data cannot be raised. This shall apply in particular to PDF's that are not version x/1-a, printed matter that is based on RGB colours, and in which the resolution is too low or in which fonts that are not embedded are used.

Short or excess shipments of up to 10% of the quantity ordered are to be accepted.

We have the right to choose between repair or replacement of faulty goods which we have delivered, and for which we have assumed liability. Should repair fail, the client will be offered a reduced purchase price. If orders are cancelled or refunded, these shall be done up to 75% of the order value to cover admin fee's and costs.

Print Data
You must carefully check the print data to determine whether it is suitable for the order before sending it to us. The customer alone will bear the risk of any errors in the printed Products owing to incorrect data supplied.

Trade Patent Rights And Copyrights
The client bears sole responsibility, if, by the implementation of his order the rights of a third party, in particular copyrights, are violated. The client declares that he is in possession of the copying and reproduction rights for the documents handed over. The client releases us of any corresponding claims from third parties concerning violation of rights.

Events Outside Our Control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under a Contract that is caused by events outside its reasonable control (Force Majeure Event).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond its reasonable control and includes in particular (without limitation) the following:

- Strikes, lock-outs or other industrial action.
- Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war
(whether declared or not), or threat or preparation for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural
disaster.
- Impossibility of the use of railways, shipping, aircraft, motor transport or other
means of public or private transport.
- Impossibility of the use of public or private telecommunications networks.
- The acts, decrees, legislation, regulations or restrictions of any government.

The Right To Vary These Terms & Conditions
I, Jenny Louise Denton, hold the right to revise and amend these terms and conditions from time to time.

You will be subject to the policies and terms and conditions in force at the time that you order Products from us, unless any change to these policies or terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to these policies or these terms and conditions before we send you the Order Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions.
